Consumer’s Right to Cancel (British Columbia)
This Agreement is subject to the Business Practices and Consumer Protection Act (British Columbia).
Nothing in this Agreement limits or restricts any cancellation rights a Customer may have under the Act or its regulations. Where the Act provides the Customer with a statutory right to cancel within a prescribed period, that right applies despite any other term of this Agreement.
Except where a statutory right to cancel applies, the Customer may cancel Monitoring Services by providing not less than thirty (30) days’ written notice to Strike Alarms and Security Ltd. Notice must be given by a method that allows proof of delivery, including email, registered mail, or written notice delivered in person.

Terms and Conditions
1. Installation
Strike Alarms and Security Ltd. agrees to install the Equipment in a workmanlike manner, subject to the following conditions:
a) The Customer shall provide access to the premises during normal business hours (8:00 a.m. to 5:00 p.m.), unless otherwise agreed.
b) Installation may require drilling and the exposure of wiring.
c) The Customer represents that they own the premises or have authority to authorize installation and that the Equipment and Services are for the Customer’s own use.
d) The Customer agrees to comply with all applicable laws, codes, and regulations in their region/municipality.
2. Condition and Testing of Equipment
The Customer is responsible for maintaining the Equipment in good working order and for replacing batteries as recommended by Strike Alarms and Security Ltd. The Customer accepts full responsibility for testing the system regularly (monthly) and for promptly reporting any malfunction for false alarms.
3. Acknowledgement of Protection
The Customer acknowledges that Strike Alarms and Security Ltd. has made recommendations regarding system design and placement, but that the Customer has selected the level of protection. Strike Alarms and Security Ltd. does not guarantee that the Equipment or Services will prevent loss, damage, or personal injury.
4. No Modification of Equipment
The Customer shall not modify, relocate, disconnect, or add to the Equipment without written authorization from Strike Alarms and Security Ltd. The Customer agrees to notify Strike Alarms and Security Ltd. of any material changes to the premises that may affect system operation.
5. Additional Services and Equipment
Any services or equipment provided beyond this Agreement are optional and subject to separate pricing agreed upon in advance.
6. Monitoring and Communication Services
Alarm signals are transmitted via telephone, internet, or cellular communication, depending on system configuration.
The Customer acknowledges that:
· Transmission may be interrupted by power failure, network outages, atmospheric conditions, or changes imposed by telecommunications providers or regulators.
· Internet, VoIP, and cellular services are not guaranteed and may fail without notice.
· Strike Alarms and Security Ltd. is not responsible for failures caused by third-party service providers.
The Customer agrees to notify Strike Alarms and Security Ltd. of any changes to communication services. Any required modifications will be billable to the Customer.
7. Fees, Late Payments, Suspension, and Reactivation
Monitoring fees are due as invoiced. Any amount outstanding more than thirty (30) days after the invoice date shall accrue interest at a rate of 2% per month (24% annually) until paid in full.
If an account remains unpaid as of the first (1st) day of the following month, Strike Alarms and Security Ltd. may, without liability, suspend or disable Monitoring Services until the account is brought into good standing. Suspension of Monitoring Services does not relieve the Customer of the obligation to pay all outstanding charges.
A reactivation fee of thirty-five dollars ($35.00) shall apply to restore Monitoring Services following any suspension due to non-payment.
Where the Customer has demonstrated a pattern of late or missed payments, Strike Alarms and Security Ltd. reserves the right, upon written notice, to require advance payment of monitoring fees for up to twelve (12) months as a condition of continuing or reinstating Monitoring Services. Any such advance payment requirement will be applied reasonably and in compliance with applicable consumer protection legislation.
Strike Alarms and Security Ltd. further reserves the right to terminate Monitoring Services upon fifteen (15) days’ written notice if payment remains outstanding.
8. Ownership of Equipment
Unless otherwise stated in writing, Equipment installed by Strike Alarms and Security Ltd. is deemed sold to the Customer upon installation. Title transfers upon full payment.
9. Term and Automatic Renewal
Monitoring Services shall continue on a month-to-month basis unless otherwise agreed in writing. The Customer may terminate Monitoring Services by providing 30 days’ written notice, and is responsible for all charges incurred up to the effective termination date.
10. Default by Customer
Failure to pay amounts owing or breach of this Agreement constitutes default and entitles Strike Alarms and Security Ltd. to terminate services, pursue collection, and exercise any legal remedies available.
11. Customer Responsibility for Equipment
The Customer is responsible for loss of or damage to Equipment after installation, except where caused by Strike Alarms and Security Ltd.’s gross negligence or willful misconduct.
The customer is responsible for reporting False Alarms to our monitoring station 1-844-811-4746 (have your all ok password and account number ready), and recommend a “two strike, then dispatch” practice.
Any deficiency must be reported in writing within 48 hours of discovery.
12. Limitation of Liability
Strike Alarms and Security Ltd. is not an insurer. The Customer acknowledges that the fees charged are not based on the value of the premises or contents.
To the fullest extent permitted by law:
· Strike Alarms and Security Ltd. shall not be liable for loss, damage, or injury arising from failure of Equipment, Monitoring Services, or emergency response.
· Liability, if any, shall be limited to the greater of $250 or three (3) months of monitoring fees as liquidated damages and not as a penalty.
· No action may be brought more than one (1) year after the cause of action arises, unless prohibited by law.
13. Personal Information
The Customer consents to the collection, use, and disclosure of personal information for service delivery, billing, credit verification, and customer communication, in accordance with applicable privacy laws.
The Customer may withdraw consent to receive promotional communications at any time.
14. Assignment
Strike Alarms and Security Ltd. may assign this Agreement without Customer consent. The Customer may not assign this Agreement without prior written consent of Strike Alarms and Security Ltd.
15. Force Majeure
Strike Alarms and Security Ltd. shall not be liable for failure to perform due to events beyond its reasonable control.
16. Notice
All notices must be delivered in writing by hand, registered mail, or email to the addresses listed on the first page of this Agreement.
17. General
This Agreement constitutes the entire agreement between the parties and is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
